Some connoisseurs believe that intellectual PROPERTY is contrary with competition law. In contrast, another group explains that there is not any challenge between them. This disagreement shows that interaction or challenge between intellectual PROPERTY and competition law is considered as variant issue and depends on the development level of countries, therefore, the legislator of any country tries to balance them by accordance of economic and develop interests and necessity.Recently, Iranian legislator has paid attention to this subject for the first time in Act on General Policies of Principle 44 of Constitution (PRIVATIZATION Act). However, this Act has not been surveyed until now, hence, this article tries to answer these questions that what are innovations and defaults of Act in the field of balancing of intellectual PROPERTY and competition law? And what is the effect of this Act on competitive atmosphere in Iran? This paper supposes that the approach of the mentioned Act is heterogeneous. The article constitutes two chapters: the first chapter considers the interaction and challenge between intellectual PROPERTY and competition law by accordance of comparative study in EU regulations; and the second chapter surveys Act on General Policies of Principle 44 of Constitution and suggests suitable and practical solutions to legislator.

Changing the ownership of the firms from governmental to other forms, along with the emphasis on cooperative ownership and increasing the share of this sector to 25% in Iran's economy, is one of the main aims of the comprehensive policies of Principle 44 of the Constitution of Islamic Republic of Iran. Therefore if such a change is supposedly true, to prove the preference of the change to cooperative sector as a sector through which the Islamic economics could be spread in the society, it should be shown that the firms operating under this kind of ownership had a better or at least equivalent performance as compared to the private or government sectors.And if no noticeable distinction in the performance of the economic firms is observed from this aspect, the emphasis on the ownership change, at least from an economic view would not be supportable.This paper strives to examine the distinctions in performance of the Manufacturing industries of the cooperative sector with the two government and Private sectors. Using plant-level data, labor productivity, and value added per unit of paid wages and salaries, employment generated, and finally the speedy growth of the employees of the manufacturing units during the Second and Third Development Plans towards segregation of ownership, are the analytical basis of This study. The results of this study show that changing to cooperative sin place of PRIVATIZATION is only possible through [handsome] productivity in the cooperative sector in comparison with the private sector, and consequently through the achievement of a level of profits equal to that of the private sector.

One of the most important discussions of recent decades in Iran and the world economic has been the issue of PRIVATIZATION and decreasing the volume of the state economic activities. PRIVATIZATION in economic literature is defined as an economic policy to balance the state activities and other economic sections with the purpose of generating perfect competition conditions and achieving more economic and social efficiency. In this research it is tried to survey Implementation barriers and problems of Art.44 of constitution on credit and financial institutes the surveyed sample in Qavamin credit and financial institute in a case matter so that it includes two main hypothesis (internal and external) and 9 lateral ones (4 related to internal obstacles and 5 related to external barriers). The current research is that of sectional applied and according to the way of gathering data is that of heuristic. It is worth to say that the statistical population in this research is high managers of branches of Qavamin credit and financial institute in Tehran city (51 high managers) plus to 10 people of experts of PRIVATIZATION organization and due to the small number we used capitation. The research findings which include a 61 people sample by examining documents, questionnaire and interview which shows that the research population along with implementing Art.44 of constitution are faced with internal barriers (structure, the level of employees' commitment and cross-organization culture) and external barriers (cultural, political, economic, social and legal).
